Terms of Sale and Digital Resource Terms

These Terms of Sale apply when you purchase a digital resource from My Therapy Hub.
Please read these terms before making a purchase. By placing an order, you agree to these Terms of Sale.
Nothing in these terms affects any rights you have under applicable consumer law.
1. About My Therapy Hub
My Therapy Hub provides practical occupational therapy information and educational digital resources relating to everyday activities, ageing, independence, caregiving, home safety, memory and thinking, and related topics.

2. About Our Digital Resources
The resources sold through My Therapy Hub are digital educational resources.

Please review the product description carefully before placing an order to make sure the resource is suitable for what you are looking for.
Digital resources are supplied electronically and no physical product will be posted unless a product is specifically described as a physical product.
3. Educational Information – Not Individual Clinical Advice
My Therapy Hub resources provide general educational and occupational therapy information.
They are not a substitute for:

The information provided cannot take account of every person's individual health, abilities, environment, risks, preferences or circumstances.
You remain responsible for deciding whether general information is appropriate to your circumstances and for obtaining individual professional advice where needed.
If you are concerned about a person's health, safety or a significant change in their abilities, seek advice from an appropriately qualified healthcare professional.
4. Prices
The price of each digital resource will be displayed on the website before you complete your purchase.
The total amount payable will be shown at checkout before payment is submitted.
Any applicable taxes or charges will be dealt with in accordance with applicable law and, where relevant, reflected during the purchase process.
We may change the price of resources from time to time.
Any price change will not affect an order that has already been completed.
5. Payment
Payments are securely processed through Stripe.
Available payment methods will be displayed during checkout.
MyTherapyHub does not intentionally collect or store your complete payment-card number or card security code where those details are processed directly by Stripe.
Stripe may carry out security, authentication and fraud-prevention checks when processing a transaction.
A purchase is not complete until payment has been successfully authorised and the order has been accepted.
6. Order Confirmation
After a successful purchase, you will receive confirmation of your order electronically, normally using the email address provided during checkout.
It is your responsibility to provide a valid and accurate email address.
Please check your spam or junk folder if you do not receive an expected order or download email.
If you experience a problem accessing a purchased resource, contact:

7. Delivery of Digital Resources
Digital resources are generally made available electronically following successful payment.
Depending on the product, this may be through:

We aim to make purchased digital content available without undue delay.
Occasional technical problems may affect delivery.
If you have paid for a resource but cannot access it, contact mytherapyhub@gmail.com so that we can investigate and, where appropriate, provide access to the resource.
8. Your Right to Cancel
Consumers purchasing online will normally have a statutory cancellation period where applicable.
Different rules apply to digital content that is supplied immediately.
Where you ask us to begin supplying downloadable digital content during the statutory cancellation period, we will ask you to:

expressly consent to the supply of the digital content beginning immediately; and

acknowledge that once supply of the digital content has begun, you will lose your statutory right to cancel that purchase.
Where the requirements for loss of the cancellation right have been satisfied and supply of the digital content has begun, you will no longer have the statutory right to cancel simply because you have changed your mind.
If the required consent or acknowledgement has not been obtained, your statutory cancellation rights will continue to apply in accordance with applicable consumer law. Nothing in this section affects your rights where digital content is faulty, not supplied, not as described or otherwise does not conform to the contract.
9. Refunds and Problems With Digital Content
We do not operate a blanket "no refunds" policy.
Your statutory consumer rights remain fully protected.
If a digital resource:

is not supplied

cannot reasonably be accessed

is materially different from its description

is faulty
-
does not meet applicable legal requirements

Where required by consumer law, we will provide the appropriate remedy. Depending on the circumstances, this may include:

The appropriate remedy will depend on the circumstances and your statutory rights.
10. Change-of-Mind Refunds
Where digital content has been supplied immediately after you expressly requested immediate supply and acknowledged the loss of your cancellation right, we are not required to provide a refund solely because you:

changed your mind

no longer want the resource

did not use the resource

purchased the wrong resource
-
expected information that was not included in the product description
This does not limit your statutory rights where the resource is faulty, not supplied or not as described.

11. Digital Content Quality and Description
We aim to describe our digital resources clearly and accurately.
Digital content supplied to consumers will be provided in accordance with applicable consumer law, including legal requirements relating to conformity with the contract.

12. Compatibility and Access
You are responsible for having a device, internet connection and software capable of opening the file type identified in the product description. We will provide reasonable information about the format of a resource before purchase where relevant.
We cannot guarantee that every digital resource will work with every device, operating system, application or assistive technology unless compatibility has specifically been stated. If a compatibility problem is caused by an issue with the digital content itself rather than your equipment or software, your statutory rights remain unaffected.
13. Personal Use Licence
Unless we expressly state otherwise, purchasing a My Therapy Hub digital resource gives you a limited licence to use that resource for your own personal, non-commercial use.
Your purchase does not transfer ownership of the intellectual property in the resource to you.
You may download and print a reasonable number of copies for your own personal use.
You may not, without prior written permission:

sell or resell the resource

upload the resource to another website

distribute copies to others

publish the resource
-
reproduce substantial parts of it

remove copyright or ownership notices

modify the resource and present it as your own work

include it in another product for sale

share the download publicly

make the resource available through shared drives, online groups or file-sharing services
If you would like to use a resource within an organisation, service, training programme or professional setting beyond ordinary personal use, please contact mytherapyhub@gmail.com to discuss permission or licensing.
14. Intellectual Property
Unless otherwise stated, the original text, resources, downloads, graphics and other original material produced by My Therapy Hub are owned by or licensed to MyTherapyHub and are protected by applicable intellectual property law. Purchase of a digital resource gives you permission to use the resource in accordance with these Terms of Sale.
It does not give you ownership of the copyright or other intellectual property rights in the resource.
15. Sharing Resources With Family Members
Many My Therapy Hub resources are designed to help older people, family members and caregivers.
You may use a purchased resource to support the person for whom you purchased it and may print a copy for that person's personal use.
This does not permit general distribution of the resource to other families, clients, organisations or members of the public.
16. Professional Use
Unless a product specifically includes a professional, organisational or commercial licence, the standard purchase is for personal use. Health professionals may refer to a purchased resource for their own learning, but purchasing one copy does not automatically grant permission to reproduce or distribute that resource to multiple clients, patients, families, colleagues or organisations. 17. Updates to Resources
We may occasionally update a digital resource to:

correct an error

improve clarity

update information

improve formatting or accessibility

reflect changes in relevant guidance
A purchase does not automatically entitle the purchaser to every future edition, replacement product or substantially expanded version unless this is specifically stated when the resource is purchased.
This does not affect any legal obligation to remedy digital content that did not conform to the contract at the time required by applicable consumer law.
18. Availability
We may add, update, withdraw or discontinue digital resources.
We may also correct pricing, description or website errors.
Removing a resource from future sale does not remove statutory rights relating to a resource you have already purchased.
19. Refusing or Cancelling an Order
We may refuse or cancel an order where reasonably necessary, for example where:

payment cannot be authorised

there is evidence of fraud or misuse

a clear pricing or technical error has occurred

the product is no longer available

the transaction would be unlawful
If we cancel an order after payment has been taken and no digital content has been validly supplied, the appropriate payment will be refunded.

Our resources are intended to provide practical general information.
People differ considerably in their health, mobility, cognition, environment, equipment needs and personal circumstances.
We cannot guarantee that every strategy, suggestion, product type or environmental change discussed will be appropriate for every person.
Where individual safety, medical needs or significant functional difficulties are involved, an individual assessment by an appropriately qualified professional may be required.
Nothing in these terms excludes or limits liability where it would be unlawful to do so.
21. Third-Party Products and Services
My Therapy Hub resources may sometimes mention examples of equipment, products, organisations, websites or services. Unless explicitly stated otherwise, such references are provided for general informational purposes and do not mean that MyTherapyHub guarantees or endorses a particular third-party product or provider.
Products and services can change over time.
You should check current specifications, suitability, availability, instructions and safety information before purchasing or using a third-party product.
Any purchase made directly from a third-party provider is governed by that provider's terms.
22. Privacy
Personal information collected in connection with your purchase will be handled in accordance with the My Therapy Hub Privacy Policy.

If you are a consumer living outside Ireland, you may also have mandatory consumer rights under the laws applicable in your country of residence. Nothing in these Terms is intended to remove any mandatory consumer protection that applies to you.
